At the time of the arrest it was believed that he was in possession of ecstasy, a known club drug. It was later discovered that he was actually in possession of the painkiller oxycontin,. Dourdan was previously arrested and charged with possession of cocaine and ecstasy in 2008 but the felony charges were dropped after he completed a 16-class drug program.

He was, however, charged with possession of drug paraphernalia.
